By accessing or using Oley Home, you agree to comply with and be bound by these Terms of Use. If you do not agree with these Terms, you must not access or use the Platform.
1. Acceptance of Terms
By accessing or using Oley Home, you agree to comply with and be bound by these Terms of Use. If you do not agree with these Terms, you must not access or use the Platform.
2. Eligibility
To use the Platform, you must: Be at least 18 years of age; Have the legal capacity to enter into binding agreements; and Provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account.
3. About Oley Home
Oley Home is an online marketplace designed to connect property owners directly with individuals seeking mid-term and long term rental accommodation. Oley Home is not a real estate agency, broker, landlord, or property manager. It acts solely as a communication platform and is not a party to any rental agreement entered into between property owners and renters.
4. User Accounts
Users agree to: Provide truthful and accurate information; Keep account information up to date; Maintain the security of their login credentials; and Notify the Platform immediately of any unauthorized access to their account. Oley Home reserves the right to suspend or terminate accounts that contain false information or violate these Terms.
5. Membership and Access Fees
Oley Home charges a one-time access fee that provides users with 30 days of access to property listings and owner contact information. Unless otherwise stated, access fees are non-refundable once access has been activated. Payment of the access fee grants access to Oley Home only and does not guarantee that a rental property will be secured or that a property owner will respond to enquiries.
6. Property Listings
Property owners are solely responsible for the content of their listings. Owners agree that listings will: Accurately describe the property; Include truthful pricing and availability; Use photographs that represent the property fairly; and Comply with all applicable laws. Oley Home reserves the right to edit, suspend, or remove listings that are misleading, fraudulent, offensive, unlawful, or otherwise inconsistent with these Terms.
7. Communication Between Users
Oley Home enables direct communication between renters and property owners. All negotiations regarding rental price, lease terms, deposits, utilities, move-in dates, and other conditions are conducted solely between the parties. Oley Home is not responsible for any communication, promises, representations, or agreements made between users.
8. Rental Agreements
Oley Home may provide a lawyer-approved standard rental agreement template for the convenience of its users. This template is intended as a general guide and does not constitute legal advice. Users are solely responsible for reviewing, modifying where necessary, and ensuring that any agreement complies with applicable laws and accurately reflects the terms agreed upon by both parties. Oley Home is not a party to any rental agreement.
9. Payments
Oley Home only collects fees relating to membership or access to its services. All rental payments, security deposits, utility payments, refunds, and any other financial transactions relating to the tenancy are conducted directly between renters and property owners. Oley Home does not process, hold, or guarantee rental payments.
10. User Responsibilities
Users agree not to: Publish false or misleading listings; Impersonate another person; Misrepresent ownership or authority to rent a property; Upload unlawful, defamatory, or offensive material; Use Oley Home for fraudulent or illegal purposes; Attempt to interfere with the operation or security of Oley Home; or Harass, threaten, or abuse other users.
11. Verification Disclaimer
Oley Home may review listings before publication to improve quality and reduce fraudulent activity. However, Oley Home does not guarantee the accuracy, legality, ownership, condition, safety, availability, or suitability of any property listing. Users are encouraged to independently verify all information before entering into a rental agreement or making any payment.
12. No Agency Relationship
Nothing contained within the Oley Home platform creates an agency, partnership, employment, joint venture, or brokerage relationship between Oley Home and its users. Oley Home does not represent either renters or property owners during negotiations or rental transactions.
13. No Guarantee of Rental Success
Oley Home provides access to property listings and owner contact information only. Oley Home does not guarantee: That users will find suitable accommodation; That owners will receive tenants; That users will receive responses from one another; or That any rental transaction will be successfully completed.
14. User Due Diligence
Users remain solely responsible for: Inspecting properties where possible; Verifying the identity and authority of the other party; Reviewing rental agreements carefully; Confirming the condition and availability of the property; and Exercising reasonable caution before making payments. Oley Home strongly recommends that no payments be made without appropriate verification.
15. Fraud Reporting
Users who suspect fraudulent listings, impersonation, scams, or other suspicious conduct are encouraged to report the matter immediately through Oley Home's reporting system or customer support. Oley Home reserves the right to investigate reports and remove listings or suspend accounts where appropriate.
16. Limitation of Liability
To the fullest extent permitted by applicable law, Oley Home shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from: Rental disputes; Property condition or quality; Misrepresentation by users; Financial loss; Cancellation of rental agreements; Personal injury; Damage to property; or Any transaction entered into between renters and property owners. Users acknowledge that all rental agreements are entered into at their own risk.
17. Intellectual Property
All content on Oley Home, including its design, branding, logos, graphics, software, and written content, is the intellectual property of Oley Home. Users may not reproduce, copy, distribute, or modify Oley Home content without prior written permission.
18. Privacy
The collection, storage, and processing of personal information are governed by Oley Home's Privacy Policy. By using the Oley Home platform, users consent to the processing of their information in accordance with that policy.
19. Suspension and Termination
Oley Home reserves the right to suspend or terminate any account that: Violates these Terms; Engages in fraudulent activity; Misuses the Platform; or Poses a risk to other users or the Platform.
20. Changes to These Terms
Oley Home may update these Terms of Use at any time. Revised Terms become effective upon publication on the Platform. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
21. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the Turkish Republic of Northern Cyprus, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.
